Standard Terms of Passenger vehicles Transportation Business

(Scope of Application)

Article 1: The transportation contracts related to the general passenger vehicles transportation business operated by our company shall be governed by the provisions of these transportation terms and conditions. and matters not stipulated in these transportation terms shall be subject to the provisions of laws and regulations or general customs.

2. If our company agrees to special terms for some provisions of these transportation terms within the scope that does not contradict the purpose of these transportation terms or laws and regulations, such special terms shall take precedence regardless of the provisions of those terms.

(Instructions from Staff)

Article 2: Passengers must follow the instructions given in the course of duty by our drivers or other staff to ensure the safety of transportation.

(Acceptance of Transportation)

Article 3: Our company will accept the transportation of passengers, except in cases where acceptance or continuation of transportation is refused under the provisions of the following article, Article 4-2, Paragraph 2, or Article 4-3, Paragraph 2.

(Refusal to Undertake or Continue Transportation)

Article 4: The Company may refuse to undertake or continue transportation in any of the following cases:
(1) When the application for such transportation is not in accordance with these transportation terms and conditions.
(2) When there are no facilities suitable for such transportation.
(3) When a special burden is requested by the applicant in relation to such transportation.
(4) When such transportation is in violation of laws and regulations, public order, or good morals.
(5) When there are transportation obstacles due to natural disasters or other unavoidable causes.
(6) When the passenger does not comply with measures taken by the crew based on the regulations of the Road Transport Act, etc.
(7) When the passenger carries items prohibited from being brought in under the regulations of the Road Transport Act, etc.
(8) When the passenger is so intoxicated that they cannot clearly state their destination or cannot walk without assistance.
(9) When the passenger is dressed in unclean clothing that could soil the vehicle.
(10) When the passenger is seriously ill and unaccompanied.
(11) When the passenger is a patient (including persons regarded as such) with a Category 1 or Category 2 infectious disease, a new influenza type infection, or a specified infectious disease (limited to those requiring hospitalization) under the Act on Prevention of Infectious Diseases and Medical Care for Patients with Infectious Diseases, or a person showing signs of a new infectious disease.

Article 4-2: In our company's non-smoking vehicles (vehicles designated as non-smoking; the same shall apply in the following paragraph), passengers are requested to refrain from smoking.

2. If a passenger smokes or attempts to smoke in our company's non-smoking vehicle, the driver will request the cessation of smoking. If the passenger does not comply with this request, in addition to refusing to accept or continue transportation, the fare and any other charges incurred until the passenger disembarks will be requested. If smoking continues, operations will be suspended for vehicle cleaning, and compensation will be sought for cleaning costs and losses due to the suspension of operations.

Article 4-3: Passengers are requested to refrain from acts contrary to laws, public order, or good morals towards our company's drivers (in this article, acts such as sexual harassment, moral harassment, or other statements or actions of passengers that, regardless of the passenger's intention, cause discomfort, harm dignity, result in disadvantage, or threaten our company's drivers (hereinafter referred to as "harassment"))

2. If harassment occurs, the driver will request it to stop, and if the passenger does not comply, in addition to refusing to accept or continue transportation, the driver or the company may report the matter to the police or other authorities. Compensation will also be sought for damages and consolation money caused by the harassment.

(Fares and Charges)

Article 5 The fares and charges collected by our company shall be those implemented with the approval of the Director of the Regional Transport Bureau at the time of the passenger's boarding.
2. Except in cases where a time-based contract has been concluded, the fares and charges in the preceding paragraph shall be based on the amount indicated on the fare meter. For vehicles without a fare meter, the price will be agreed upon by both parties before boarding.

(Collection of Fares and Charges)

Article 6 Our company shall request payment of fares and charges upon passengers getting off.

(Liability to Passengers)

Article 7 Our company shall be liable to compensate for damages caused to the life or body of a passenger due to the operation of our vehicles. However, this shall not apply if our company and our personnel can prove that no negligence was committed in the operation of the vehicle, that intent or negligence was due to a third party other than the passenger or our personnel, and that there were no structural defects or functional problems in the vehicle.
2. In the case of the preceding paragraph, our company's liability to passengers shall begin when the passenger boards and end upon disembarkation.

Article 8 In addition to the preceding article, our company shall be liable to compensate for damages suffered by passengers in connection with our transport services. However, this shall not apply if our company and our personnel can prove that no negligence was committed in connection with the transport.

Article 9 Our company shall not be liable to compensate for any damages suffered by passengers if measures such as a temporary suspension of operation are taken to ensure transport safety due to natural disasters or other reasons for which our company cannot be held responsible.

(Passenger Responsibility)

Article 10 Our company may seek compensation from passengers for any damages suffered by our company caused by the passenger's intentional or negligent acts or due to the passenger’s failure to comply with laws, regulations, or the provisions of these transport terms.
